Terms of Service
1. Who we are
Auto Resource (“Auto Resource”, “we”, “us”) is operated by Auto Resource Australia, trading as Auto Resource, ABN 91 360 761 290. You can contact us here. These Terms of Service apply to your use of the Auto Resource website and any related services (the “Platform”).
2. What Auto Resource is
Auto Resource is an online classifieds platform that lets sellers list cars and motorbikes for sale and lets buyers browse, search, and contact sellers directly. We are not a party to any sale or purchase agreement formed between a buyer and a seller, we do not inspect, test, or certify any vehicle listed on the Platform, and we do not verify the accuracy of prices, condition, ownership, or roadworthiness of any listing. Buyers and sellers transact with each other directly and are responsible for satisfying themselves about a vehicle before agreeing to buy or sell it.
3. Accounts and identity verification
You must be at least 18 years old to create an account. You must provide accurate information and keep your login details secure — you are responsible for activity that happens under your account. Before you can publish a listing, we require you to upload a photo ID document. This is used to reduce fraudulent and fake listings; it is not a background check, and submitting an ID document does not constitute a guarantee by Auto Resource of a user's identity, trustworthiness, or the accuracy of anything they list. 4. Listing rules
Listings must be for a genuine vehicle that the seller has the legal right to sell, and must accurately describe the vehicle's condition, specifications, and any money owing or finance encumbrance against it. You must not list stolen vehicles, post duplicate or spam listings, or use the Platform for anything unlawful, fraudulent, or misleading. We may remove a listing, without refunding any fee already paid, if it breaches these rules or if we're asked to by a law enforcement or regulatory body.
5. Fees and payments
Listings are free to publish until 31 December 2026. From 1 January 2027, publishing a listing costs a flat fee of $99 AUD, charged at the time you publish or renew the listing. This fee is for advertising your vehicle on the Platform — it is charged regardless of whether the vehicle actually sells, and is separate from any price you agree with a buyer. Payments are processed by Stripe; Auto Resource does not receive or store your full card details. Once a listing has been published, the fee is non-refundable, except where required by law or where we remove your listing due to our own error.
6. Disclaimers and liability
The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Auto Resource excludes all liability for any loss arising from a transaction between a buyer and seller, from the condition or description of a listed vehicle, or from the conduct of any user. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. We strongly recommend buyers inspect a vehicle in person, check its PPSR record, and use safe, verifiable payment methods before completing any purchase.
7. Termination
You may close your account at any time. We may suspend or terminate an account that breaches these Terms, engages in fraudulent or abusive behaviour, or where we reasonably believe it's necessary to protect the Platform or its users, with notice where practicable. Sections of these Terms that by their nature should survive termination (including liability and intellectual property) continue to apply after your account is closed.
8. Intellectual property
You retain ownership of the photos and descriptions you post, but by publishing a listing you grant Auto Resource a non-exclusive licence to display, reproduce, and promote that content on the Platform and in related marketing. The Auto Resource name, logo, and website design remain our property and may not be used without permission.
9. Changes to these terms
We may update these Terms from time to time, for example as new features are added or laws change. We'll update the date below when we do, and material changes will be highlighted on the Platform.
10. Governing law
These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
